Abstract

Most judicial systems in various countries of the world are moving to benefit from artificial intelligence techniques in the field of criminal justice, and given the time and effort that artificial intelligence techniques save, some foreign countries have deemed that employing this technology in the judicial system has become an urgent matter, and from here, some experiments have emerged. In these countries, artificial intelligence technologies have been used in the field of criminal investigation and judicial assistance, and these technologies have been used to decide cases, as happened in China, Estonia, Canada, and some American states.

The importance of the research lies in the fact that it attempts to identify the controls for the use of artificial intelligence techniques in the field of criminal justice. It also sheds light on many questions about the challenges posed by this approach, including those related to the principles of criminal justice, especially the principle of the presumption of innocence, and the risks related to transparency and the extent of the danger of relying on automated systems in conducting trials and issuing judgments in light of the emergence of what is known as biased algorithmic decisions.

Through international experiences in this regard, the research attempts to determine the pros and cons, and the suitability of the legislative structure in our Arab world to benefit from these techniques to the extent that is commensurate with the requirements of criminal justice.
