Abstract
Direct investments play an important role in the economic development processes of various developed and developing countries. This is perhaps due to the trend of world economies towards more economic liberalization and openness, the decline of the state’s role in the economic field in favor of the private sector, and the increase in giant economic blocs, which results in increasing the attraction of private investment as one of the basic mechanisms for improving reform, economic growth, and full employment.
In addition to the importance of issuing legislation and laws that stimulate investments and provide various guarantees, facilities and incentives that facilitate attracting foreign investments, legislation is the tool through which the state extends its dominance over relations between itself and individuals on the one hand and between individuals themselves on the other hand.
The great importance of investments, especially in improving macroeconomic indicators, enhancing GDP, providing jobs, increasing production and other great advantages, has motivated countries to reform the economic and financial legislative system that can affect investment.
In the Kurdistan Region of Iraq, an investment law was issued bearing No. (4) of 2006, which included important legal texts that work to attract investments, whether local or foreign, which resulted in improving the investment climate in Iraqi Kurdistan, especially in the field of real estate investment and others. Despite the law including important guarantees and incentives to attract investment, there are still many obstacles that prevent investment from assuming the desired position.
