 Abstarct
In civil proceedings, thanks to gradual electronization involving the use of devices and software, civil proceedings were accelerated, costs were reduced and the possibility of communicating with the court without leaving home was made possible, which not only facilitated the day-to-day functioning of courts but also increased trust in the judicial authorities. The recent amendments to the Civil Code, the Code of Civil Procedure and other acts in Poland introduced the next stage of computerization of civil proceedings, extending the use of electronic tools. Similar changes and the introduction of electronic tools took place in enforcement proceedings. Not only is it possible to perform activities in an electronic form, but also bailiff files are to be kept in such a form. The restrictions related to COVID-19 were a particular impulse to introduce new solutions. Many regulations modified certain actions taken by enforcement authorities and parties of enforcement proceedings by attributing a separate electronic form thereto. The newly introduced regulations constituted a breakthrough for the electronization of judicial enforcement proceedings in Poland, resulting from the quick development of modern information technology (IT). There are some amendments to the regulations that concern the issue of a writ of execution for an enforcement order that exists in an electronic form and the issue of a European enforcement order certificate to court rulings given in the electronic procedure by writ of payment. Other provisions include new possibilities of submitting petitions or statements by e-mail in enforcement proceedings; under other regulations (e.g., concerning e-auctions and the seizure of a bank account), such communication will be exclusive. Currently, an important aspect of electronization of judicial enforcement proceedings there is regulations of electronic enforcement title, electronic bailiff files as the only form of keeping files and reducing costs and the need for archiving, e-auctions. So, the main aim of this elaboration is to give an answer to whether the enforcement proceedings in Poland are computerized.
