\n

Abstract:<\/b> The title of the research is ( Hadith ” The father no be punished (killed) when he kills his son” \u2013 a study in prophetic hadith sciences and comparative jurisprudence and law).
\nIt’s talking about punishment father if he killed his son in the Islamic jurisprudence and Iraqi punishment laws. So in the first time it is studying the Hadith (prophetic tradition) that said ” The father no be punished (killed) when he kills his son”, and showed the hadith is a weak (Daeef)\u00a0 that according to science of the hadith, then it present\u00a0 views of the Islamic jurist that they have been three deference view about the issue, the first one say the father doesn’t be killed if he killed his son at all, the second say he must be killed at all like others, and the third say\u00a0 should be there detailing and specification on the issue, finally\u00a0 it view position of the law on the issue and showed there no deference between father and others in punishment.<\/p>\n
