{"id":739,"date":"2018-06-19T13:41:45","date_gmt":"2018-06-19T13:41:45","guid":{"rendered":"http:\/\/ishik.edu.iq\/conf\/ilic\/?page_id=739"},"modified":"2018-06-19T13:44:59","modified_gmt":"2018-06-19T13:44:59","slug":"research-11-ilic-2018","status":"publish","type":"page","link":"https:\/\/conferences.tiu.edu.iq\/ilic\/research-11-ilic-2018\/","title":{"rendered":"research-11-ilic-2018"},"content":{"rendered":"<h3><b>Research Title:\u00a0&#8211; \u0627\u0644\u062a\u0643\u064a\u064a\u0641 \u0627\u0644\u0642\u0627\u0646\u0648\u0646\u064a \u0644\u0644\u063a\u0644\u0637 \u063a\u064a\u0631 \u0627\u0644\u0645\u0634\u062a\u0631\u0643 \u0628\u064a\u0646 \u0627\u0644\u0645\u062a\u0639\u0627\u0642\u062f\u064a\u0646 &#8211; \u062f\u0631\u0627\u0633\u0629 \u0645\u0642\u0627\u0631\u0646\u0629<\/b><\/h3>\n<p><strong>Author: Dr. Hiwa Ibrahim qadr<\/strong><\/p>\n<div align=\"justify\">\n<p><b>Abstract:\u00a0<\/b>This research aims to clarify the legal adaptation of the non &#8211; common error between the contractors in light of the provisions of Iraqi civil law and comparative legislation, based on the comparative analytical approach to solve the problem of the\u00a0 Iraqi legislator&#8217;s vision and the comparative legislation of the case of non \u2013 common error from the perspective of the contractor who was wrong, without regard to silent of other contractor, who knew the contractor was wrong and did not alert him to it, one of the most important conclusions of the research is that the silence of the contractor in this case is considered as a fraud\u00a0 in the light of the provisions of the comparative legislation, because the law contractor would not have signed the contract if it had known that it was fundamental error, and that the legal adaption of the non-common error between the contractors &#8211; subject matter of the research &#8211; was to be regarded as a unilateral error of one of the contractors and a fraud by silence by the other contractor. One of the recommendations of the research is the need for a legislative amendment to avoid duplication in the defects of will in the case of a non-common error in which one of the contractors is silent about the error in which the other contractor falls, by taking this situation &#8211;
