Abstract: of the research titled “The Legal System of Electronic Transactions” deals with the extent to which electronic transactions are handled electronically. We have noticed that by comparing e-commerce and e-commerce legislation, most legislations deal with electronic transactions within the legal controls and conditions. The study pointed out the need to document the electronic transactions, because of the nature of transactions and the fact that they are remote, and this stresses the need to ensure in advance of the seriousness and integrity and free from fraud. As for the reliability of electronic transactions, most Arab and non-Arab legislation has seen the subject of the obligations of service providers Certification and e-business owners to the standard care standard, not an obligation to achieve an end, in an effort to encourage individuals and companies to use e-business to express their direction towards their goals. Electronic transactions as a means of documenting electronic bonds are subject to the traditional rules of proof themselves in most Arab and non-Arab legislation. The existence of certification bodies is a factor of denial of data, falsification of electronic transactions and falsification of evidence according to traditional evidence without legal basis. And the adaptation of penal laws with the latest developments in the era, the emergence of information crimes and the falsification of electronic transactions and electronic bonds to be compatible with the huge development of electronic processing technology and means of documentation and the extent of the enjoyment of confidence and safety and protection The law is governed by the provisions of traditional contracts, including matters of personal status, wills, waqfs, dispositions of property, models of cases, communications and securities. So that the traditional legislation does not constitute barriers and obstacles to the development of electronic means in the field of evidence and other legal facts, so we propose to amend local legislation in an effort to coordinate and adapt to The rapid and amazing development of electronic means and their entry into the fields of human life and its specificities.
