Abstract
Legislative policies have adopted flexibility within the texts of the Commercial Companies Law due to the importance of keeping up with economic reforms to achieve sustainable development. This is what the Algerian legislator has followed, emulating comparative laws over the past decade in companies with financial consideration. It began with accepting the share by work in limited liability companies and abolishing the legal capital limit in them. Then, it introduced simple joint-stock companies, “one-person joint-stock companies,” and moved towards decriminalizing management and administration actions in terms of the penal aspect in commercial companies.
The economic development and the accompanying development of legislative positions makes us aim through this research paper to shed light on money companies due to their economic importance in the money market; This is to discuss the motives of legislative developments from the organizational and Algerian side in the money companies in terms of achieving the initiatives of economic reforms, especially since the strength of commercial markets is different between countries, which resulted from various problems; Therefore, we ask the question while legal developments are in money companies? What is its suitability with the Algerian commercial reality?
To address the posed question, the descriptive method was adopted concerning the identification of legal systems for regulatory and penal legal developments; in addition to the analytical and comparative method regarding the issues in the legal and factual evaluation of legal developments with economic reforms between Algeria and France as a model. According to the following plan:
Chapter One: Regulatory Developments in Capital Companies.
Chapter Two: Recent Developments in Corporate Criminal Law.
