Abstract:  The topic of intersexuality is one of the controversial topics that exist in society, which has seldom been mentioned in the scope of scientific research. However, there are some exceptional legal articles and some scholars’ theological opinions on this issue without depending on modern medical sciences. In this research, the sex of intersexual people is being discussed and decided based on the modern medical sciences have illustrated intersexuality in detail. Furthermore, this study is focusing on the effective results, taken from modern medical sciences, influencing or changing the various opinions of Islamic scholars, which has also been mentioned in the personal status law of some countries. This research has been divided into three chapters, and the first chapter comprises of definitions, types, and theological opinions of Islamic scholars about dealing with intersexes and how inheritance should be shared with them as well as the method of identifying the scholars’ basic decisions about receiving inheritance. In the second chapter, the types of intersexes and the physical parts of their bodies are being discussed in relevance to biology and physics, and the identification of sexual dominance of intersexes has also been pointed out based on medical and scientific results. Moreover, the third chapter focuses on a section in the personal status law of some Arab countries about dealing with interse in accordance with the effect of modern medical sciences on reevaluating legal articles based on the last scientific and medical results.
