Abstract
The provisions of the laws of countries differ on the subject of engagement, and this is due to the difference in the social idea on which the concept of engagement is based, Some of these ideas are based on making engagement a binding contract that cannot be withdrawn frome, thus creating contractual responsibility in the event of non-fulfillment, Some of them subject it to the law of the suitor’s nationality, based on the rules of conflict in marriage, making it a binding contract like the marriage contract, Some of them consider it a promise to marry that does not have the force of obligation and commitment. This difference resulted in conflict between the laws of countries, and prompted countries to organize legal jurisdiction by establishing specific attribution rules that determine the law governing engagement in form, subject, and effects.
