Abstract
This paper discusses the legal basis for the human right to a clean and safe environment, in accordance with both international and national law. This right is closely linked to the rights to life, health, and well-being, reflecting a growing recognition of the importance of the environment in human life. Given the significance of this topic, all domestic, national, international, and Islamic legislations have addressed it. The human right to a healthy environment is considered a newly developed right. This study aims to establish a legal framework to protect the human right to live in a clean, safe, and balanced environment, providing effective protection. The research problem lies in the environmental issues that have necessitated their integration into human rights. The study relied on several methodologies, including descriptive, historical, and analytical approaches. The study arrived at several key findings, most notably that there are numerous challenges that limit the effectiveness of international and national legal texts. Furthermore, the environmental right is the human right to live in a healthy and clean environment, ensuring health and well-being, and preserving biodiversity. This right is considered a fundamental human right, and it is closely linked to other rights such as the rights to life, health, and well-being.
