Abstract

Due to the privacy of sports disputes and the advantages of sports arbitration compared to the ordinary (national) judiciary, and the desire of the sports community to settle its sports dispute by themselves, as well as the existence of the Lex Sportiva Act, have made sports arbitration an alternative and unparalleled means of justice in the sports space on a national and international scale, in particular in the legal systems of sports federations and bodies and national legislation. On the international scale, most international sports federations have included a clause in their sports regulations that prohibits resorting to national courts to settle sports disputes, but the dispute must be ended through arbitration as well as amicable means such as conciliation and mediation. There is same the case in national legal systems such as the Iraqi legal system.

Accordingly, this research deals with what are sports disputes and the means of settling these disputes, in particular sports arbitration, mediation and sports reconciliation, as well as that the research focused on the status of sports arbitration in the Iraqi legal system to resolve sports disputes through a statement of the judicial structure of the Iraqi Sports Settlement and Arbitration Center and the legal source of its mandate as well as the legal rules followed by the Iraqi Sports Settlement and Arbitration Center and how to appeal its decisions.
