Abstract: Iraqi Council of Representatives In its regular session number 23rd on the 27/9/2017 lead by Dr. Saleem Al- Jbori) the speaker of Iraqi Representative council (Perelman), with the attendance of the Iraqi federal prime minister Dr, Hayder Al Abadi and Iraqi consultants Minister of Defense and Interior and minister of OIL with (184) parliament members drafted decision number (55) related to (Kurdistan Referendum ) when none of the Iraqi Council of Representative Kurdish members attendance.As stated in one of this decision points that Kurdish are one of the essential component of Iraq and it should be protected, however the session was held without their presence.
The decision made was forcible to the Iraqi prime minster to implement, as some saw that the decision made wasn’t applicable to Iraqi constitution, it was mostly political. This research investigated and compared the decision’s points number (55) with the applicable Iraqi Constitution and the Universal Declaration of Human Right in order to answer these questions that the decision made depending on the international law and applicable laws.
